1. Agreement
These Terms & Conditions govern the use of the ZoneFit website, products, and services.
By accessing our website, requesting a quote, approving artwork, placing an order, or purchasing products from ZoneFit, you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms & Conditions, you should not use our website or services.
2. Our Services
ZoneFit provides custom apparel, merchandise, uniforms, promotional products, embroidery, printing, branding, and related services.
All products are supplied subject to availability and production capacity.
ZoneFit reserves the right to refuse any order at its discretion.
3. Quotations
All quotations are valid for 30 days unless otherwise stated.
Quotes may be amended if artwork, quantities, garment selections, decoration methods, freight requirements, or other specifications change after the quotation has been issued.
4. Artwork Approval
Customers are responsible for carefully reviewing all artwork proofs before providing approval.
Artwork approval confirms acceptance of:
- Design layout
- Spelling and grammar
- Colours
- Garment selections
- Decoration locations
- Quantities
- Sizes
Once artwork approval has been received and production has commenced, ZoneFit accepts no responsibility for errors present within the approved proof.
5. Production Timeframes
Estimated production timeframes are provided as a guide only.
While every effort is made to meet estimated delivery dates, ZoneFit is not liable for delays caused by suppliers, freight carriers, weather events, public holidays, equipment breakdowns, or circumstances beyond our reasonable control.
6. Custom Products
All custom-made products are manufactured specifically for each order.
As such, custom orders cannot be cancelled, refunded, or exchanged once production has commenced, except where required under Australian Consumer Law.
7. Customer Supplied Artwork
Customers warrant that they own or have permission to use any logos, artwork, trademarks, images, or designs supplied to ZoneFit.
The customer indemnifies ZoneFit against any claims arising from copyright, trademark, or intellectual property infringement relating to supplied artwork.
8. Intellectual Property
All artwork, mockups, concepts, proofs, website content, graphics, and marketing materials created by ZoneFit remain the property of ZoneFit unless otherwise agreed in writing.
9. Limitation of Liability
To the maximum extent permitted by law, ZoneFit's liability is limited to the replacement, repair, or refund of the affected products.
ZoneFit shall not be liable for indirect, consequential, incidental, special, or economic loss arising from the use of our products or services.
10. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any rights available under Australian Consumer Law.
11. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
